Civil Process

The Sheriff has a statutory responsibility for serving civil process papers. To accomplish this task, the Sheriff's Office has a Civil Process Unit. This unit consists of one Deputy and one clerical position. Their primary responsibility is the service of civil process papers, handle evictions, reposes vehicles and hold Sheriff’s sales on foreclosed property. Thousands of civil process papers are served annually.

 

Fees are waived only when papers for service are accompanied with signed court ordered waiver of fees for indigence. Fees are due and payable within thirty days of service or pre-payment may be required of the plaintiff for future service.

 

Any additional information including phone numbers, workplace and hours, vehicle, date of birth or physical descriptors included with the papers for service saves excessive fees and officers' time. One complete copy is needed for service upon the person or company and one cover sheet of the document is needed.

 

If after three attempts, service is unsuccessful, contact will be made with the plaintiff for further instructions. Otherwise attempts will be made until such a time as the serving deputy deems it is futile to continue or plaintiff indicates in a cover letter the maximum attempts to be made.

 

All sheriff sales are held on Wednesdays at 10:00 A.M. in the south main entrance of the Dunn County Judicial Center at 615 Stokke Parkway,  Menomonie, WI .

 

Fees:

  • $75 for posting sheriff sales and $75 for holding the sale.
  • $35 a Service,  plus mileage established at the current IRS rate, and $35 for each attempt, up to three attempts.
  • WRITS-$35/hour- ,minimum one hour, plus mileage (current IRS rate)

Fingerprinting

Public fingerprinting (for Dunn County residents only*) is done on Fridays from 9:00 AM to 11:00 AM at the Dunn County Sheriff's Office. No appointments required.

*includes students of UW Stout with valid school identification card.

The Sheriff's Business Office is an important part of having successful day-to-day operations and good customer service. Business office employees are responsible for many different things, including:

- Typing officer-dictated police reports.
- Filing all paperwork in records.
- Computerizing all police records and reports in the Records Management System (RMS).
- Answering and forwarding calls to the business office.
- Forwarding paperwork and reports to District Attorney's Office as needed.
- Participation in the Dunn County Check Diversion Program for bad check reports.
- Processing of Civil Process papers.
- Issuance of Temporary License Plate Registrations.
- Issuing copies of police reports.
- Filing required paperwork with the state in reference to citations, license violations, OMVWI and more.

Dunn County Check Diversion Program
For victims that receive worthless checks

Goals of the Program
The check diversion program has four main goals. They are:
- Increase the amount of restitution returned to victims of bad checks
- Increase the accountability of all worthless check writers, regardless of the amount of the check
- Promote to local merchants more effective check acceptance and protection procedures
- Reduce the risk of repeat worthless check activity through proper training

Program Summary
1. Checks are entered into the FCS system.
2. Check writers are contacted by the FCS restitution program regarding the checks. Four scenarios are then generally possible:
     A. Check writer pays the Check Diversion Program - 100% of the face value of the check is returned to the merchant plus bank fees if paid. Any restitution received (even partial payment) will be forwarded to the merchant within a month of receipt from the check writer.
     B. Offender completes a financial counseling program offered by the Check Diversion Program.
     C. Check writer fails to pay - the check is sent for prosecution review and proceedings.
     D. If check is not at prosecutable limit check writer is red flagged. The system will then notify if more checks are entered and prosecution review is done again.

Checks Eligible for the Program
- NSF, Account Closed, Refer to Maker, Debit card charge backs, ACH NSF's and Electronic Checks received that do not exceed $2500.00. If your check exceeds $2500.00, please report to law enforcement.
- Worthless checks LESS THAN 120 DAYS from the date issued by the check writer. (exception: first time users to the program can send checks up to 2 years old.)

Obtaining Copies of Police Reports
In reference to the Wisconsin Open Records Law, Wis. Stat. 19.31-19.39, the Sheriff's Office will provide copies of requested closed police reports in accordance with the law. To obtain copies of police reports, contact the business office. There are general processing fees associated with the request. Police reports can only be issued by business office staff. Deputies cannot release records without supervisor approval, so please do not contact deputies for cases they may have handled.


Court Security
The Dunn County Sheriff's Office Court Security Deputy is part of the Support Division and supervised by the Chief Deputy. The Court Security Deputy is responsible for maintaining security within the courtroom and judicial center. Inmates of the Jail are escorted into the courtrooms though private halls and elevators by correctional staff. The Court Security Deputy also provides courtroom security and assistance to courtroom officials, judges, and the jury.

All persons entering the Judicial Center are subject to being searched.

Certain items are not allowed inside the courtroom. If you have any of these items in your possession, you will asked to secure them inside or vehicle and leave the building:

- Firearms
- Scissors/Knifes
- Pepper Spray/Mace
- Razor Blades
- Heavy Chains/Pocket Wallet Chains
- Glass Items/Certain Metal Items
- Handcuff Keys

Cellular phones are permitted, but need to be shut off or turned on silent while in the courtroom. Prior to entering the courtroom, hats or caps shall be removed. Persons disrupting the court may be found in contempt by the presiding judge.


Court Officer
The court officer is a part time employee assigned to coordinate all citations and arrest paperwork with the courts. They also maintain records pertaining to the disposition of citations and ordinance violations.



Transport Officers
Transport officers are civilian employees that are used to transport prisoners between facilities throughout the state. The use of civilian transport officers is cost effective and efficient.
